Toronto Spinal Cord Injury Lawyers

A spinal cord injury completely changes your life and the lives of those you love.

Paralysis changes everything.  And, of course, it results in huge financial costs for ongoing medical care, attendant care, medical equipment, adaptive technologies, specialized medicines, and supplies.  Even a  healthy paraplegic may need $600-1000 per month of pharmaceutical products.  That adds up quickly.

At Auger Hollingsworth, we have helped many Ontario clients with spinal cord injuries ranging from quadriplegia to paraplegia to other forms of spinal fractures.  This experience has brought home the incredible personal and family tragedy which results from a spinal cord injury.  At the same time, it has helped us see how, with proper financial compensation and support, spinal cord injury victims can go on to live happy and meaningful lives.

Spine Injury Lawyer Near You

Spinal Cord Injury LawyerIf you were in an accident and find yourself looking for a “spinal cord injury lawyer near me”, it’s hard to know what attorney to choose. When deciding on an attorney, ask about the lawyer’s experience with catastrophic injuries.  Is your lawyer prepared to engage the specialists required to assess your long-term medical needs and to quantify the cost of those needs?  This very important step in your case requires hiring a certified life care planner.

Your spine injury may be from a car accident, slip and fall, or another serious accident. Regardless, the back injury lawyers at Auger Hollingsworth are nearby and would be pleased to meet with you for a case analysis and ultimately representation.

As if the paralysis itself is not a big enough issue, our spinal cord injury lawyers also know that injury victims face a greater susceptibility to health-related problems such as bedsores, pressure sores, bladder infections, kidney stones, upper respiratory infections, pneumonia, skin contractions, and others.  These “side effects” have both a human and a financial cost that must be taken into account when advancing your claim for compensation.

Recovery After a Back Injury

Our Toronto spinal cord lawyers work with economists, vocational rehabilitation specialists, physiatrists, life care planning experts, neurologists, neurosurgeons, and neuroradiologists in your representation.  We take all steps possible to ensure that client’s current and future needs are properly analyzed and valued. Some common types of recoveries for a spine injury include:

Home and Vehicle Modification

Home and vehicle modification are significant expenses for people with spinal cord injuries. These expenses have to be quantified and advanced to the insurance company on your behalf. Where the spine injury was caused by a car accident, we will work with your accident benefits insurer to ensure that your needs are met to the full extent available under the statutory accident benefits regulation.

Barriers to Employment

Back injuries can create a significant barrier to gainful employment.  Our attorneys seek compensation for your past and future lost wages, health care insurance, and pension or retirement benefits. We will also assist you to engage in vocational counseling and accommodating devices when it is possible for you to return to work.

Caregiver Expenses

Where our client requires a caregiver, we assist you with funding through the accident benefits insurer if possible.  If there is a shortfall, or if no accident benefits are available, we will seek those damages from the defendant.

The devastating effects of a spinal cord injury on your spouse, children, parents, and sometimes siblings must also be acknowledged.  Our team seeks damages for loss of consortium, loss of care guidance and companionship, and loss of household services among other things.  Family counseling may also be required and funding for that need claimed.

Spinal Cord Injury FAQs

What is a spinal fracture?

A spinal fracture is a break in a bone in your back.  The bones in your back are called vertebrae.  Sometimes the vertebrae in your back are referred to by letters and numbers.  There are 33 individual bones that interlock with each other to form the spinal column. The vertebrae are numbered and divided into regions.  Starting at the top of your spine, the regions are cervical, thoracic, lumbar, sacrum, and coccyx.  Your vertebrae have a hollow centre.  Your spinal cord runs up through the middle of the vertebrae.

A fracture or dislocation of a vertebra can cause bone fragments to pinch and damage the spinal nerves or spinal cord. Spine fractures range from painful compression fractures, which can happen in relatively minor traumas in people with osteoporosis, to more severe injuries such as burst fractures and fracture with dislocations that happen after auto accidents or falls from height. These more severe injuries often create spinal instability.

What causes a spine fracture?

Most spinal fractures occur from car accidents, slip or trip and falls or sports.

Is there treatment available?

Treatment for a spinal fracture depends on the severity of the break, the location of the break, and whether the spinal cord is affected.  In certain situations, rest and pain management will be enough.  In more serious situations, surgery may be required, especially if the bones have moved.

How can a personal injury lawyer help you after a spinal fracture?

If your spinal fracture is the result of someone else’s negligence, our experienced accident and injury lawyers in Ontario can help you with:

  • Locating the best rehabilitation services available for your spinal fracture injuries
  • Funding for medical and rehabilitation costs not paid for by OHIP or your extended health care benefits
  • Compensation for your loss of income or loss of competitive advantage
  • Compensation for your pain and suffering and loss of enjoyment of life
  • Obtaining long term disability benefits if you need them.
  • And more.

Our lawyers regularly help clients just like you who have suffered a spinal fracture following a car accident, slip and fall, or another traumatic event.

Selecting Your Toronto Spinal Cord Injury Lawyer

Spinal Cord Injury Lawyer TorontoIf you or a family member in the Greater Toronto Area has had a spinal cord injury caused by negligence, it is very important to retain a personal injury law firm that is structured to handle a big, complex, catastrophic case.

Getting the most out of your settlement or trial verdict will make a big difference in the life of someone with a spinal cord injury.  Here are three considerations to weigh when choosing your lawyer:

Does the lawyer and the law firm specialize in personal injury and accident law?

This issue is vital for many reasons.

You want a Toronto personal injury law firm with a team of lawyers, law clerks, investigators and paralegals.  Large cases need large teams of professionals committed to maximizing your result.

You also need a law firm that appreciates that catastrophic cases take time.  At multi-service law firms with competing practice areas, law partners who do not practice personal injury can get frustrated when significant cases take too long.  Those lawyers want to get paid as soon as possible.  At a personal injury law firm like Auger Hollingsworth, our lawyers understand the client’s needs.

Does the lawyer and the law firm have the capital (money) to fully prosecute your claim?

Your case needs a personal injury firm that has the financial resources to afford to spend the money (disbursements) needed to push your injury case to the limit.  Big cases are expensive.  Sometimes there are six-figures in experts and other out of pocket expenses a lawyer will spend to get the maximum for your case.  You have to make sure you select a lawyer who can afford to pay for the experts and other expenses associated with maximizing your settlement compensation.

How much spinal cord injury case experience does the lawyer or law firm have?

Choose a lawyer and a law firm who have represented people with spinal cord injuries in the past.  Inquire about a firm’s past successes.  You should also ask the law firm about challenges in past spinal cord cases and how they worked to overcome those challenges.

A major injury like a spinal cord injury requires a lawyer and a law firm with an experienced team that will take all available steps to ensure that every dollar available is secured for your future.
